Welcome to 1958. These Terms of Service ("Terms") constitute a legal agreement between you and 1958 ("we," "us," or "our") governing your use of the 1958 mobile application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App after any such modifications constitutes your acceptance of the new Terms.

2. Description of Service

1958 is a mobile application designed to provide NHL hockey fans with:

• Live game schedules, scores, and updates
• Comprehensive team and player statistics
• Standings and playoff position tracking
• A prediction game feature called "Puck Predictor"
• Favorites management and personalized notifications

All data provided through the App is sourced from the official NHL Stats API v1 and is provided for informational and entertainment purposes only.

3. User Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

4. User Account

Some features of the App may require you to create an account or provide certain information. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated systems to access the App without our prior consent
• Collect or harvest any information from the App without authorization
• Engage in any conduct that restricts others' use of the App

6. Puck Predictor Feature

The Puck Predictor is a free, entertainment-only prediction game. By using this feature, you acknowledge and agree that:

• No Real Money: Puck Predictor involves no real money, betting, or gambling of any kind.
• No Prizes: Points and streaks earned are for personal entertainment only and cannot be redeemed for cash, prizes, or any items of value.
• Personal Use: Your predictions and scores are stored locally for your personal enjoyment.
• Entertainment Only: This feature is designed purely for fun and to test your hockey knowledge.

We expressly prohibit the use of our App or any of its features for gambling or betting purposes. We are not responsible for any third-party activities or misuse of information obtained from our App.

7. Intellectual Property

The App, including its design, features, content, and functionality, is owned by 1958 and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

NHL, the NHL Shield, the word mark and image of the Stanley Cup, and all NHL logos and marks are trademarks of the National Hockey League. All other trademarks are the property of their respective owners. The use of NHL data does not imply endorsement by the NHL.

8. Third-Party Services

The App may contain links to or integrate with third-party services, websites, or applications. We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your use of such services is at your own risk and subject to the terms and conditions of those services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The App will be uninterrupted, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected
• The App is free of viruses or other harmful components

While we strive to provide accurate information, we make no guarantees regarding the accuracy, completeness, or timeliness of any data displayed in the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1958 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

11. Indemnification

You agree to indemnify, defend, and hold harmless 1958, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after any changes indicates your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 1958 operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 1958 regarding the App and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and us.
